1. Scope of Application
The business relationship between souvenirshop.shop (hereinafter referred to as the provider/seller) and the customer (hereinafter referred to as the ‘customer’) is exclusively governed by the following General Terms and Conditions (GTC) in their current version at the time of ordering. Deviating conditions of the customer will not be recognized unless the seller expressly agrees to their validity. A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or their independent professional activity (§ 13 BGB). The GTC also apply if access to the offer is made from outside the Federal Republic of Germany.
2. Conclusion of Contract
souvenirshop.shop reserves the right – despite the utmost care – to possible printing errors, mistakes, and color changes of the products depicted in the online shop. The presentation and promotion of articles in the online shop of souvenirshop.shop do not constitute a binding offer to conclude a purchase contract. By submitting an order via the online shop by clicking the “Pay” button at Paypal or Woopayments, the customer places a legally binding order for the goods contained in the shopping cart. The confirmation of receipt of the customer’s order takes place together with the acceptance of the order immediately after sending by an automated email. If the delivery of the goods ordered by the customer is not possible, for example because the corresponding goods are not in stock or will not be available in the foreseeable future, both parties have the right to withdraw from the purchase contract. In these cases, souvenirshop.shop will inform the customer immediately and refund any payments already received without delay.
3. Prices and Shipping Costs
The prices stated at the time of ordering in the respective item description apply, plus the costs for shipping. All prices stated are inclusive of the applicable statutory value-added tax at the time of performance. For international transfers, the customer is responsible for foreign charges (transfer fees). Shipping within the Federal Republic of Germany costs a flat rate of 5.00 euros. For other countries, please inquire about shipping costs. The buyer bears any additional costs such as customs duties, import taxes, and other fees for orders outside the EU.
4. Delivery, Product Availability
The product availability is indicated on the respective product detail page. Unless otherwise stated, the delivery time is 3-10 working days. If an item is permanently unavailable, souvenirshop.shop will inform the customer, and a contract will not be concluded in this case. In such a case, souvenirshop.shop will promptly refund any payments already made by the customer. If not all ordered products are in stock, souvenirshop.shop is entitled to make partial deliveries at its own expense, provided this is reasonable for the customer.
5. Payment Terms
Payment is made via Paypal or Woopayments (credit card, debit card), where the customer has the option of paying by credit card, direct debit, or Paypal account, subject to the terms and conditions of Paypal.
6. Warranty, Guarantee
The warranty is based on legal regulations. A guarantee exists for the goods delivered by the seller only if it has been expressly given.
7. Liability
For liability of the seller for damages, the following exclusions and limitations of liability apply without prejudice to the other statutory requirements. The seller is liable without limitation in cases of intent or gross negligence. Furthermore, the seller is liable for slight negligence in the event of a breach of material obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the customer regularly relies. In this case, the seller is only liable for foreseeable, contract-typical damages. The seller is not liable for slight negligence in the breach of obligations other than those mentioned in the preceding sentences. The above liability limitations do not apply in case of injury to life, body, and health, for a defect after assuming a guarantee for the quality of the product, and for concealed defects. Liability under the Product Liability Act remains unaffected. To the extent that the seller’s liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents.
8. Data Protection
In the initiation, conclusion, processing, and reversal of a purchase contract, souvenirshop.shop collects, stores, and processes data within the framework of legal provisions. Souvenirshop.shop processes personal data exclusively for the purpose for which it was collected and in accordance with legal provisions. The personal data provided for the purpose of ordering goods (such as name, email address, address) will be used by souvenirshop.shop to fulfill and process the contract. This data will be treated confidentially and will not be disclosed to third parties who are not involved in the ordering, delivery, and payment process. To the extent that souvenirshop.shop refers or links to third-party websites in its internet offer, souvenirshop.shop cannot assume any guarantee and liability for the accuracy or completeness of the contents and the data security of these websites. Since souvenirshop.shop has no influence on compliance with data protection regulations by third parties, the respective data protection declarations offered by the customer should be separately reviewed.”
